Divorce is a relatively simple process. There is no requirement that one party be at fault. For the Court to grant a divorce, all that is required is:
- That the parties had been validly married;
- The parties have been separated for at least 12 months, and
- Appropriate arrangements have been made for the care of the children of the relationship
If you need to divide any assets in your separation (such as a house or business) you are not required to have reached an Agreement as to how these items will be divided, before obtaining a Divorce. However, you do have a set period after being granted a Divorce to make the appropriate application for the allocation of these items. You will need to consult a Solicitor before these time limits expire.
